Terms and Conditions

Last updated 19 October 2026.

These terms cover enquiries made through this website and photography sessions that are later confirmed in a written estimate with Pinakx Photography. They explain how an enquiry becomes a booking. They are not a substitute for the estimate. The estimate states the hours, the fee, the place, and the licence for a particular job.

The studio

Pinakx Photography is the name used on this website. The site does not publish a registered office, a telephone number, or a business number. If a later estimate includes a legal name or a tax number, that document controls for the invoice. Until an estimate is accepted, these website terms govern how enquiries are handled.

How a booking is made

A booking follows these steps:

  1. You send an enquiry through the contact form. That is a request for a reply. It does not reserve a date, a photographer, or a location. If the form says the message was not sent, no enquiry has been received.
  2. The studio may reply with a written estimate, ask a clarifying question, or decline. A written estimate states the fee, the hours, the city, the kind of session, what will be delivered, and the licence.
  3. A session is booked only when you accept that estimate in writing and meet any deposit the estimate requires.

A deposit that is not described in the estimate is not part of the booking. The studio may decline an enquiry without a detailed reason, including when the date cannot be taken or when travel has not been agreed in the estimate.

Payment, cancellation, and postponement

The website does not take payment and it does not publish prices. Any fee, currency, tax, deposit, and payment timing are stated in the estimate, not on this page.

Your responsibilities

You agree that the details you send are accurate enough for a reply, and that you have the right to share any names or plans you include. You are responsible for permission to photograph the location, and for telling guests, employees, or household members that a photographer will be present. You are responsible for access, for parking instructions you want followed, and for the people who need to be there on time. For commercial, product, and real estate work, you are responsible for having the authority to grant the licence you are asking to receive. The photographer will follow reasonable safety directions on a workplace or industrial site.

Photographs made for you

Copyright in photographs made for your booking remains with the photographer unless a written assignment says otherwise. What you may do with those files is stated in the estimate, or in a later written agreement. If that document is more specific than this page, the document controls.

Photographs on this website

Images published on pinakx.com are licensed stock photographs. They illustrate a kind of setting and light. They were not made for you, and they are not part of the licence you receive if you book a session. They are not evidence of a past client, a venue partnership, or a review. Do not present them as photographs from your own session.

Delivery

Edited files are delivered by the method and on the timing written in the estimate. The website does not promise a fixed number of days, because that number depends on the session and is written into the estimate when one is sent. The website does not store the photograph files and it does not provide an online client gallery. Weather, a late start, or a location that was not ready can change what can be photographed. The photographer will say so at the time. Delivery of what was actually possible does not require the studio to supply frames that were not made.

Liability

The studio is not liable for a venue’s rules, a guest’s refusal to be photographed, or a product that was not provided in a photographable condition. Nothing in these terms excludes liability that Canadian law does not allow to be excluded, including liability for death or personal injury caused by negligence where such an exclusion would be invalid. Subject to that, liability arising from a booking is limited to the fee you paid for that booking.

Governing law

These website terms are governed by the laws of Canada and by the laws of the province where a confirmed session takes place. If no session is confirmed, questions about the website terms are governed by the laws of Canada and the laws of the province in which you live. The federal courts or the courts of that province may hear a dispute, without changing any right you have as a consumer that cannot be waived.

Privacy

Personal information submitted through the form is handled as described in the Privacy Policy. Accepting an estimate also means the contact details in the enquiry may be used to carry out that booking. The cookie described in the Cookie Policy only records that you acknowledged the cookie notice.

Contact

Questions about these terms go through the contact form. Begin the message with “Terms question” so it is not treated as a new session request. If the form says the message was not sent, the question has not been received.
